She assists and represents French and foreign companies, on both transaction and litigation matters relating to:
• Digital advertising, cookies and other trackers, direct marketing, audience measurement and data monetization.
• Artificial Intelligence, facial recognition, health data processing, processing under the Police and Justice Directive, drafting of data protection impact assessments.
• Cybersecurity: whether to anticipate a cyberattack (cybersecurity policies, business continuity plan, information systems security policy, etc.), or reacting to it (notification to supervisory authorities, affected individuals, medias, cyber insurers, filing a criminal complaint).
• IT and commercial contracts: SaaS contract, license agreement, data sharing/transfer agreement, DPA, SLA, purchase agreement, GT&C, NDA, partnership agreement.
• CNIL procedures (on-site downraids, request for information, formal notice and sanction procedures), and court proceedings (Council of State).
• Rights of data subjects (including DSAR), balance of the legitimate interests, lawfulness of consent, prior information to data subjects, telephone recording, CCTV regulation.
• Data sharing: within a group (e.g. sharing of marketing data for cross brands advertising purpose), with business partners, outside the European Union (EU-US Data Privacy Framework, BCR, SCCs).
• Retail and e-commerce : online intermediary service platforms, DSA, regulation of influencers, online gambling and competitions, deceptive commercial practices.
• Cyber-harassment and e-reputation.
• IP: software and trademark infringement.
Joséphine was admitted to the Paris Bar in 2018. Before joining Hogan Lovells, Joséphine was an associate in the IP/IT/Privacy team in one of the largest US-based law firms.

Assisting professional associations representing media, e-commerce and digital advertising ecosystems in France in litigation relating to the "cookies" legal framework.

Assisting a French airports company on a facial recognition project before the French privacy authority.
