The U.S. Justice Department has issued a final rule on bulk sensitive personal data that will significantly impact cross-border data transfers and transactions, particularly for companies in the life sciences and health care, financial services, manufacturing, and technology sectors. The final rule significantly expands DOJ’s authority over export of or access to bulk data, establishes a new national security program, and creates a complex regulatory environment for cross-border data transactions. Within the short period provided by DOJ to comply, U.S. organizations with global operations will need to invest considerable efforts to assess their relationships with countries of concern and identify data flows between parties.
