Courtney regularly represents financial institutions in commercial litigation and regulatory enforcement matters. She has experience representing foreign- and U.S.-based companies in securities class action defense, shareholder derivative suits, M&A-related litigation, and litigation emanating from other transactions involving contests for corporate control. Courtney also is a member of the firm's Sports, Media & Entertainment team, as she represents various entities within the sports sector.

Representative experience

Close corporation shareholder dispute: Successfully defended company and president/shareholder in derivative action alleging claims of breach of fiduciary duty.*

Employment discrimination trial: Successfully defended the School District of Philadelphia against claims of ADA and FMLA violations brought by an employee.*

FINRA trial: Secured full defense verdict for clients against claims of fraud and unsuitability by issuing promissory notes without proper disclosures and misrepresenting assets of owner and company.*

Hedge fund preferred shareholder dispute: Secured victory for preferred shareholder in claims for breach of share purchase agreement centering around the definition of "securities."*

Idea theft dispute: Successfully prosecuted idea theft claim stemming from a creative director’s submission of marketing and community growth strategies to a technology company during its early phase.

Investigated the due diligence and process of the New York State Joint Commission on Public Ethics (JCOPE) in approving Gov. Andrew Cuomo's request to author a book during the COVID pandemic. 

King's Bench proceeding: Successfully defended District Attorney's Office against petition seeking disqualification for alleged conflict of interest in defending the conviction of Mumia Abu-Jamal.*

Licensing dispute: Successfully represented licensor in dispute alleging improper use of its proprietary information.

Prisoner civil rights trial: Sole counsel and court-appointed attorney representing prisoner in a civil rights litigation.*

Securities litigation: Defended an executive and board member against a securities class action claiming – among other things – the deal undervalued the target company.*

Securities litigation: Defended foreign energy company against securities class action with allegations of improper accounting, misrepresentation, and inflation of earnings.*
