Data protection and cyber security compliance has become a critical area for management focus in the Asia-Pacific (“APAC”) region.
China’s introduction of its Personal Information Protection Law (“PIPL”) has generated significant uncertainty, but it is now clear that the broad contours of the regime include a movement by China towards the gold standard of GDPR, coupled with a focus on “cyber sovereignty” that adds important departure points from the reference point EU law.
A flurry of legislative amendments across the wider APAC region generally show a more selective approach to GDPR adoption, but the trendline is clear. As Australia, Hong Kong, Indonesia, India, Japan, Singapore, Thailand, Vietnam and other jurisdictions move to upgrade their data protection laws, it has become increasingly clear that organizations in APAC must adopt a fresh approach to compliance, taking into account the accountability-driven approach championed by GDPR and recognizing that regulatory fines are moving sharply higher and will continue to do so in coming years.
