Alex Kay is a partner based in London, and part of the Restructuring & Special Situations team.  

He typically represents buy side investors and bondholder committees in complex cross border restructurings assisting his clients in all aspects of a transaction from initial contingency planning and investment analysis to implementation and management of complex work outs.  

Alex has particular experience of assisting creditors in challenging jurisdictions and is one of the go to lawyers for difficult emerging markets situations often using market first restructuring tools to reach a solvent solution. His work encompasses using a range of insolvency and reorganization tools and processes including restructuring plans, schemes of arrangement, pre-packaged administrations, Chapter 11 processes and a number of other European reorganization tools to achieve his clients' goals. Alex has also acted for investors on a number of complex direct lending financing transactions often using complex and bespoke debt instruments and Inter-creditor structures.

Hilding Anders: Representing the ad hoc committee of lenders in the on-going restructuring of a Swedish manufactuer and retailer of lifestyle products.

GN Terminals: Advising credit funds in the ongoing multijurisdictional enforcement of over US$150M of outstanding debt with Ukrainian port operator G.N. Terminals Enterprises.

Atento: Advised the adhoc bondholder committee holding majority of c$1bn NY law bonds issued by the Luxembourg holding company of this LatAm business on a restructuring using a UK restructuring plan.

Sandhill Petroleum: Representing a credit investor in the loan to takeover of a Hungarian oil and gas E&P company.

Naftogaz: Representing the ad hoc committee of 2026 Noteholders in the restructuring of bonds issued by Ukraine’s state owned gas distribution company. 

GOL: Advising the ad hoc committee of senior secured notes in the restructuring of this Brazilian airline through Chapter 11 proceedings.

DTEK Energy: Acting for the lender committee in the successful restructuring of Ukraine’s largest energy company. 

Global Ports Holdings: Representing the ad hoc committee of senior noteholders in the restructuring of notes issued by this Turkey based cruise port operator.

Mriya Agro: Advising the senior noteholder committee and acting as transaction counsel in the landmark US$1 billion restructuring of this this Ukrainian agricultural company.

Interpipe: Advising a material creditor in the successful  restructuring of this Ukrainian steel pipe producer.

Agrokor: Advising ad hoc noteholder committee on restructuring $4-6bn debt owed by Croatian business in new special administration, including provision of $1bn DIP funding.

Avangardco / UkrLandFarming: Advising a US based hedge fund the successful recovery action against these Ukrainian farming companies following payment default on their notes.

Lemtrans: Assisting a US based hedge fund in the acquisition and successful restructuring of approx. US$150 million of non-performing loans backed by railcars in Ukraine.

Roust Corporation: Advising a provider of senior secured financing to this international spirits and distribution and production business.
