With over 30 years of experience, Gary Orseck has led some of the nation’s most high-profile business litigation cases. He is highly skilled in in defending federal securities class actions and shareholder derivative suits, often involving claims exceeding US$1 billion. His clients include top national public health care companies, hedge funds, banks, and public accounting firms.

A seasoned trial lawyer, Gary has successfully handled a wide range of civil cases, including breach of contract, business torts, copyright and trademark infringement, professional liability, and employment disputes. He regularly defends large accounting firms in SEC and PCAOB investigations and enforcement actions.

Gary has led trial teams in numerous federal jury trials, including a software infringement case, a collective action against the City of New York under the Fair Labor Standards Act, and a complex breach of fiduciary duty claim.

A founding partner of Robbins, Russell, Englert, Orseck & Untereiner LLP, Gary served as the firm’s Managing Partner for most of its 20-year existence. He previously served in the Civil Division of the U.S. Department of Justice, where he received numerous awards for distinguished trial work, before turning to private practice with the Washington, DC, office of a global law firm.

Representative experience

Led defense for all defendants in a US$1.5 billion class action and derivative suit over alleged improper admission practices at 200+ behavioral health facilities, securing dismissal of both cases.*

Led defense for all defendants in securities class action against an electronics company, alleging illegal channel stuffing and seeking hundreds of millions, securing dismissal on motion to dismiss.*

Defended a bank and its senior officers in a US$500 million suit over a canceled wire transfer to an entity claiming to supply 100 million N95 masks, securing full dismissal on summary judgment.*

Represents as lead counsel the family of a Holocaust survivor, asserting claims against the Federal Republic of Germany based upon the Nazis’ theft of the family’s priceless art collection.*

Led defense for defendants in a US$1 billion putative class action over alleged misleading hospital billing practices, settling the case on favorable terms after years of litigation.*

Represented as lead counsel defendants in a shareholder class action arising from the spinoff of a new public hospital company, settling the case on favorable terms.*

Represented independent directors of publicly traded investment fund in Royal Court of Guernsey in US$1 billion fiduciary duty case, securing verdict for defendants, affirmed by Court of Appeal.*

Led defense for defendants in a shareholder class action seeking hundreds of millions over alleged misstatements about patient care and billing, settling the case just before trial.*

Led defense for former directors of an investment fund in a putative class action seeking hundreds of millions, securing dismissal at the pleading stage, later affirmed on appeal.*

Represented as lead counsel a major defense contractor in a jury trial concerning allegations of copyright infringement and breach of license, settling the case after the court declared a mistrial.*

Represented as lead counsel nearly 16,000 New York City police officers and detectives in a Fair Labor Standards Act suit, winning summary judgment on overtime rate claims.*

Part of trial team representing the Official Committee of Unsecured Creditors of TOUSA Inc. in a fraudulent conveyance action, securing over US$500 million in damages for the client.*

Represents numerous large accounting firms in PCAOB and SEC investigations.*
